	Real estate appraisers, particularly those operating in rural areas of the U.S., have admitted that the Home Valuation Code of Conduct had affected their business in some way or another. The Code was introduced in 2009 and was developed by mortgage giant Fannie Mae.</p>
<p>
	Under the code, appraisers are required to collaborate with the appraisal service management units of lenders instead of the individual or group who are putting the mortgage loan together for the property being appraised. According to market experts, the Code was implemented to create a buffer between lenders and property appraisers and avoid collusion between these two.</p>
<p>
	The Code will supposedly prevent lenders who write the loan mortgages from influencing appraisers in their evaluation of a property and in deciding what the property&#39;s worth should be. The Code has been deemed largely successful by most industry observers, although some appraisers have admitted that it does have some negative impact.</p>
<p>
	Rural real estate appraisers have stated that it sometimes pose a problem, particularly if the appraisal unit of the lender is based outside the area where the property that will be appraised is located. They stated that most city appraisal companies have no idea how things are done and how properties are appraised in rural regions.</p>
<p>
	They also added that it is somehow cumbersome to have to drive to a farther location just to talk with the appraisal unit since most banks have their appraisal firms in another location. They stated that if the Code were not in place, they could just walk across the road and talk with the bank issuing the mortgage for the property.</p>
<p>
	Despite these small concerns, appraisers have asserted that the Code has done a lot of good for the housing industry. Generally, the impact on their businesses is not detrimental, although they stated that it increased the workload of their office managers who are tasked with putting together documents and facilitating communication between the appraisal firm and the appraisal unit of the lender which is almost always located outside the local area.</p>
<p>
	Most real estate appraisers have also admitted that they would have preferred to use local appraisal servicers since they are the ones who knew the nature of the city or the county&#39;s housing market.</p>

	The letters were sent to 57 property owners, most of whom are Hispanic or African Americans, telling them to expect a visit from an appraiser who will work on determining the value of their properties. Several residents have revealed that they were surprised by the decision of the township. Some have also stated that they were not given any warning about the eminent domain.</p>
<p>
	The redevelopment program will affect a commercial area and 500 residences in Mount Holly Gardens. Most of the properties have already been acquired and demolished by the township, but none of those properties were acquired through eminent domain.</p>
<p>
	Meanwhile, lawyers who represent the township have stated that the official eminent domain process has been started on some of the remaining homes and properties. They revealed that the process requires them to hold residential appraisals, after which negotiations and offers for the properties will follow.</p>
<p>
	The entire Gardens neighborhood was declared a redevelopment zone by the township council in 2002. Council officials have claimed that the move was prompted by the high crime rates in the area and the blight that encompasses the neighborhood. However, lawyers who represent the residents have asserted that the news came without warning and that most of the residents who will be affected by the redevelopment had no idea that the procedure of eminent domain has already started.</p>
<p>
	They further added that up until May 2010, the township gave no indication that the process is already underway. On the contrary, lawyers for the residents have asserted that the council had indicated that they are only proceeding with the first phase and that only those lands adjacent to residential properties will be affected.</p>
<p>
	Homeowners&#39; legal counsels have also explained that, should homeowners refuse to sell their homes and properties during the negotiations that will be held once the residential appraisals are completed, township authorities can immediately take over the properties under the power of eminent domain.</p>

	The Department of Property Valuation and Review, the state <a href="http://appraisal.foreclosuredeals.com/">property appraisal services</a> unit of Vermont, has made an unprecedented move when it recalculated the Common Level of Appraisal (CLA) of the town of Stratton using a study that lasted for six months. Typically, a CLA is calculated using a three-year period of study.</p>
<p>
	Department officials have admitted that this move is unusual and will result in a very low CLA. The purpose of CLA is to bring statewide education taxes at the same levels and ensure that properties with the same value will be required to pay the same amount of taxes.</p>
<p>
	The shorter period used by the department to calculate Stratton&#39;s CLA gave the town a 92.65% CLA as opposed to the 79.49% that it received as of the end of 2009. This led to the town&#39;s tax rate dropping to $1.48, which represents a 24-cent decrease from the initial $1.72.</p>
<p>
	According to the appraiser, Stratton requested for a recalculation because of drastic changes in the area&#39;s market. Because of this development, the state&#39;s property appraisal services agency has come up with some procedures and criteria just in case another situation similar to Stratton&#39;s arises in the coming months.</p>
<p>
	Officials explained that there are two factors that would convince the department to forego the usual three-year period study in favor of a shorter period. These two factors are smaller samples and those samples being &quot;statistically valid&quot; and markedly different from the results provided by the traditional three-year study.</p>
<p>
	Officials also added that before they agreed to Stratton&#39;s request for a recalculation, they looked at what process can be used in place of the usual three-year period. They revealed that they examined the town using a one-year study period, but the results were not too different from the three-year period results, hence the decision to use six months.</p>
<p>
	Furthermore, they were able to prove that a drastic change in sale prices occurred and that this drastic change is very recent. In the case of Waterbury, a town which also requested for a recalculation, officials claimed that the sample did not exhibit a difference that warrants special consideration.</p>
<p>
	Although Vermont&#39;s property appraisal services department accommodated Stratton&#39;s request for a CLA recalculation, it believes that this will not lead other towns and cities in the state to request for similar considerations.</p>

	Lawyers who represent <a href="http://appraisal.foreclosuredeals.com/">real estate appraisal services</a> firms in the U.S. have reported an increase in the number of lawsuits being filed against their clients as the <a href="http://www.foreclosuredeals.com/foreclosure-crisis/">foreclosure crisis</a> continue to affect the country&#39;s residential property market.</p>
<p>
	According to law firms that work with these appraisers, the only difference in the 2010 period is that, instead of a big number of lenders filing the lawsuits, borrowers are the ones who fill the courts to complain against appraiser companies, claiming that they would not have bought their properties if they had been aware that these properties were not worth the money they paid for them.</p>
<p>
	Law firms have estimated that around 75% of the total number of lawsuits against appraisers was filed by borrowers. Around 2,000 lawsuits have been filed so far, creating annual damages worth $100 million in the whole country. Law firms have added that most of the lawsuits filed were buyers&#39; remorse cases.</p>
<p>
	Legal professionals have asserted that the crucial factor in appraiser-client relationships is information integrity. They explained that home buyers and other real estate appraisal services clients should be provided with information that can help them make informed and intelligent decisions on what is commonly considered as the most significant purchase of their whole lives.</p>
<p>
	Inaccurate information on such cases can take a heavy toll on the business of selling and buying real properties, attorneys have added. They also observed that lawsuits filed by borrowers against appraiser companies are even higher now than during the crisis that involved savings and loans companies. This was partly explained by legal analysts as resulting from majority of borrowers getting approved for loans which they cannot afford to pay in the first place.</p>
<p>
	Some lawyers have defended appraisers, claiming that most of the lawsuits are results of predatory lending by loan providers and appraisers just get dragged into it. Most of the time, lawyers are able to get appraiser companies out of trouble through motions.</p>
<p>
	Law firms are expecting the number of borrower lawsuits against real estate appraisal services firms to continue to rise, with lenders also expected to weigh in on appraiser troubles, as more banks in the U.S. are expected to foreclose in the coming months.</p>

	<a href="http://appraisal.foreclosuredeals.com/">Appraisal service</a> bills were passed recently in the states of Indiana, Oregon and New Mexico recently. The Indiana and Oregon bills are still to be signed by Governors Mitch Daniels and Ted Kulongoski, respectively, while the New Mexico bill was already signed into law by Governor Bill Richardson.</p>
<p>
	After the Indiana and Oregon bills are passed, the two states would become the 7th and 8th states to pass legislation on how appraisal management companies should conduct their operations. In 2009, similar laws were passed by California, Nevada, Arkansas, Louisiana and Utah. More than 20 of the other states are still considering appraisal company legislation, which is mostly about the accountability, transparency and responsibility of AMCs.</p>
<p>
	The Oregon bill has a provision different from most other states ? the supervisory agency. Unlike in other states, where the implementation of AMC registration and regulation rests with the state board of appraisers, Oregon AMCs will be supervised by the Department of Consumer and Business Services.</p>
<p>
	According to Scott DiBiasio, government relations manager for the Appraisal Institute, the change was primarily due to concerns that board members, who are also registered appraisers, may conduct appraisal for AMCs. Additionally, the appraiser board has limited number of representatives from other financial institutions.</p>
<p>
	Under the appraisal service law in Indiana, all AMCs in the state are required to keep detailed records of all appraisal assignments, including fees paid by AMCs to appraisers and the amounts paid by lending institutions to the AMCs for their management services.</p>
<p>
	AMCs in Indiana will be supervised by the board of real estate appraiser certification and licensure. In addition, appraisals done for properties located in Indiana will be reviewed by appraisers licensed in Indiana.</p>
<p>
	In New Mexico, AMCs are required to post surety bonds or other forms of security with the state Department of Regulation and Licensing. All AMC employees that review appraisals should be knowledgeable about the local housing market described in the appraisal reports.</p>
<p>
	Additionally, the law requires AMCs to disclose appraisal fees and to eliminate provisions in their job contracts with appraisers that place unfair burdens on appraisers, such as appraiser indemnification of any AMC liability arising from the appraisal.</p>
<p>
	Minda McGonagle, a lobbyist for the Santa Fe chapter of the appraisal association, lauded the legislation and its role in requiring appraisal service providers to generate correct and fair appraisal reports and in requiring AMCs to be more responsible in handling appraisers and in serving consumers.</p>

	<a href="http://appraisal.foreclosuredeals.com/">Real estate appraisal service</a> providers are becoming a bane to real estate agents who are doing their best to survive during the struggling market. Agents have been losing sales after sales because the house valuations made by appraises are coming in far below the asking prices.</p>
<p>
	According to the National Association of Realtors, almost one out of every four realtors has reported at least one client losing a home sale because of the extremely low appraisal.</p>
<p>
	The National Association of Home Builders also reported that about one-fourth of total new home sales have been botched up because the appraisals were too low. Home builders said that the prices of brand new homes should not be based on the prices of <a href="http://www.foreclosuredeals.com/distressed-properties/">distressed properties</a>.</p>
<p>
	In response, real estate appraisers argue that distressed properties are part of the housing market. A house appraiser in San Diego, California, Katherine Scheri, said she has been branded a deal killer because her appraisals are considered too low by agents.</p>
<p>
	For instance, her recent appraisal for a house originally priced at $310,000 was $30,000 below the price offered by the buyer. When the agent told her she is going to ruin a buyer?s dream, she shot back that the agent should care that the buyer could lose $30,000 from buying the house.</p>
<p>
	According to real estate appraisal service providers, they cannot ignore the prices of comparable <a href="http://www.foreclosuredeals.com/">foreclosure home sales</a> because a huge percentage of house sales are distressed sales. In 2009, around 40 percent of total house sales in most parts of the country were <a href="http://www.foreclosuredeals.com/foreclosure-short-sales/">short sales</a> or foreclosure sales.</p>
<p>
	In some markets, the percentage is even higher. In Phoenix and in Las Vegas, the distressed sale percentage has surpassed the 50-percent level.</p>
<p>
	Home appraisal professionals determine house value by examining recent comparable sales in the area, making adjustments for features like basement renovation or excluding features like above-ground swimming pool. Generally, appraisers do not use distressed sales for comparison, but in cases where foreclosures are the only sales in the area, appraisers cannot avoid considering them.</p>
<p>
	According to San Diego-based appraiser Scheri, some buyers are willing to pay much more than what the properties are worth even in neighborhoods where foreclosure sales comprise the majority.</p>
<p>
	To pursue sales of homes valuated low by real estate appraisal service providers, real estate agents can advise buyers to pay a portion of the price in cash to encourage sellers to reduce their selling price.</p>

	Residential appraiser legislation is being pushed in Arizona by appraisers concerned about the bad reputation of home appraisers in the state.</p>
<p>
	Members of the Coalition for Arizona Appraisers have called on state legislators to craft regulations that would regulate their profession and that would impose penalties on individuals that damage the appraisal profession.</p>
<p>
	Licensing for appraisers has long been implemented in Arizona, but a number of reputable and professional appraisers claim that inefficient and bad appraisers are still able to conduct appraisal work for clients. During the housing boom, a lot of appraisers inflated their home valuations so borrowers can get approval for higher loans.</p>
<p>
	With lessons from the resulting foreclosure crisis, one would think that inflated or inaccurate appraisals are a thing of the past, but these defective valuations still proliferate. According to observers, while there are a lot of inaccurate valuations done by inexperienced appraisers, there are more faulty valuations done by appraisers who are serving the interests of certain parties.</p>
<p>
	These appraisers, according to analysts, deliberately exclude certain market information in order to facilitate the sale of the homes being appraised.</p>
<p>
	In Arizona, a residential appraiser becomes certified only after completing 150 hours of education in appraisal and 2,000 hours of training and working under a veteran appraiser. The appraiser must also pass the state appraisal exam and a criminal background check.</p>
<p>
	There are about 2,800 residential appraisers in Arizona and they are supervised by the Arizona Appraisal Board, which was created in 1991 to approve licenses, handle complaints against appraisers and hold disciplinary hearings.</p>
<p>
	Despite the authority of the board to revoke or suspend licenses, many appraisers think that the board has been too lenient, allowing the proliferation of inflated or defective appraisals. The board has dismissed ten percent of complaints it has received this year and eight percent of complaints last year. The licenses of ten appraisers were revoked last year.</p>
<p>
	Bill Barnes, founder and leader of the Arizona Appraiser Association and appraiser for Glover Valuation Group, said that the Appraisal Board has not been doing its job of monitoring the activities of appraisers. He added that complaints are usually dismissed without proper investigation.</p>
<p>
	In response to complaints about the board, Appraisal Board vice chairperson Debra Rudd stated that the board is underpaid and overworked and she reiterated that board members are doing their best to ensure that every residential appraiser in Arizona complies with appraisal regulations.</p>
